It is age restricted not banned, the same as cigarettes, driving and many other things.

I was up in Brooklyn about 4 years ago on a business trip. Cigarettes aren't banned, but for what packs cost up there compared to what they cost in the Southeast, I mean they're not banned but that's expensive enough to convince anyone to try to quit. I very rarely ever smoke anymore. But even in June it's as cold at night up there as it is here during the daytime in the Winter.
